Terms & Conditions
1. Definitions
– MSK TAKEAWAY LTD: The provider of the Service, registered at 43 Womersley Road, Knottingley, WF11 0DB, United Kingdom.
– Customer: Any person who uses the Service, places an order, or purchases food from MSK TAKEAWAY LTD.
– Order: A request by the Customer for food and/or drinks from MSK TAKEAWAY LTD, whether online, by phone or in person.
– Payment Provider: A third-party service (e.g., PayPal, Stripe) used to process online payments for orders.
2. Order Placement & Acceptance
– All orders are subject to availability of ingredients and our confirmation. We reserve the right to reject or cancel any order at any time (e.g., out of stock items, peak time capacity).
– When you place an order, you make an offer to purchase our products. We accept this offer by sending an order confirmation email/SMS – a binding contract is formed at this point.
– You are responsible for providing accurate order details (e.g., delivery address, contact number, dietary requirements) – we are not liable for errors caused by incorrect customer information.
3. Pricing & Payment
– All prices on our website and menu are in British Pounds (GBP) and include VAT (where applicable). Prices are subject to change without prior notice – the price at the time of order confirmation is the price you will pay.
– We accept online payments via major credit/debit cards and third-party payment providers (e.g., PayPal). All payments are processed securely by our Payment Providers – we do not store your card details.
– Cash payments are accepted for in-person takeaway orders only.
– We reserve the right to charge a small fee for card payments (if applicable) – this will be clearly displayed at checkout.
4. Delivery & Takeaway
– Our delivery and takeaway terms are outlined in our Shipping Page – these form part of these Terms.
– We are not liable for any loss or damage to food caused by late delivery, unless the delay is due to our gross negligence.
– You are responsible for receiving your delivery at the specified address – we are not liable for undelivered orders due to an unattended address (a re-delivery fee may apply).
5. Dietary Requirements & Allergies
– We provide detailed ingredient and allergy information for all our dishes (on our menu/website). However, our kitchen handles nuts, gluten, dairy and other allergens – we cannot guarantee a 100% allergen-free environment.
– It is your responsibility to inform us of any dietary requirements, allergies or intolerances at the time of ordering. We will take all reasonable steps to accommodate your request, but we are not liable for any adverse reactions to food unless caused by our gross negligence.
6. Intellectual Property
– All intellectual property rights (e.g., trademarks, logos, menu content, website design) on our Service are the property of MSK TAKEAWAY LTD. You may not copy, reproduce, modify or distribute any of our intellectual property without our prior written consent.
7. Liability
– MSK TAKEAWAY LTD will not be liable for any indirect, incidental, special or consequential loss or damage arising from the use of our Service (e.g., loss of time, inconvenience, missed events).
– Our total liability for any direct loss or damage arising from a breach of these Terms or defective food is limited to the value of the order in question.
– We are not liable for any disruptions to our Service caused by events outside our control (e.g., natural disasters, power outages, supply chain issues, third-party service failures).
8. Termination
– We may terminate or suspend your access to our online ordering service at any time, without notice, if you breach these Terms (e.g., fraudulent payment, abusive behaviour towards our staff).
– You may cancel your order at any time before it is prepared by our kitchen – contact us immediately to request a cancellation. Cancellations after food preparation has started may not be accepted (a partial refund may apply at our discretion).
9. Changes to These Terms
– We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with a new effective date. Your continued use of our Service after the effective date constitutes your acceptance of the revised Terms.
10. Governing Law & Jurisdiction
– These Terms shall be governed by and construed in accordance with thelaws of England and Wales.
– Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
